Second Amendment Rights

Rep. Kelly is a strong believer in the Second Amendment of the Constitution of the United States. It protects law-abiding citizens from the government’s infringement on our right to keep
and bear arms. The Founding Fathers felt this right was important enough to make it part of the Bill of Rights, and held that the right to keep and bear arms was the personal and fundamental
right of all citizens.
The following is a list of Rep. Kelly’s efforts to protect our Second Amendment rights:
- Concealed Carry Across State Lines: Rep Kelly is an original cosponsored and supporter of H.R. 38, the Concealed Carry Reciprocity Act, which would allow Americans with a license to carry a concealed firearm in one state to possess a concealed handgun in another state that permits concealed carry. For example, it doesn't make sense that a resident of Pennsylvania can lawfully carry a concealed firearm with a permit inside the Commonwealth but go to jail for doing so while simply passing through Maryland.
- NYSRPA v. Corlett Supreme Court Amicus Brief: Rep. Kelly signed onto an Amicus Brief sent to the Supreme Court to protect the Second Amendment rights enshrined in the Constitution. Many states, including New York, Massachusetts, and California, unconstitutionally restrict this right by requiring concealed carry applicants to justify their need for the permit, empowering local and state authorities to reject applications from law-abiding Americans for arbitrary reasons or for no reason at all. Specifically, this case will decide if New York’s law concerning concealed-carry licenses for self-defense violates the Second Amendment.
- Support for Military Families: Rep. Kelly is a support and cosponsor of H.R. 1013, the Protect Our Military Families' 2nd Amendment Rights Act, which would allow military spouses to purchase handguns in the state where their husband or wife is permanently stationed for duty, or in a neighboring state if the military spouse commutes across state borders to their duty installation.
- Fighting Against Gun Registries: Rep Kelly is an original cosponsored and supporter of H.R. 1827, the Gun Owner Registration Information Protection Act which would prohibit states, localities, or any other organization from using federal funding to maintain gun registries.
- Opposing the Biden Administration’s Proposed Rule on Pistol Stabilizing Braces: Rep. Kelly is an original cosponsored and supporter of H.R.4312, the NFA SBS Act. This legislation would remove Short-Barreled Shotguns (SBSs) from the National Firearms Act (NFA) to allow SBSs to be treated just as any other shotgun, thus preventing the Bureau of Alcohol, Tobacco, and Firearms (ATF) from forcing otherwise law-abiding gun owners to destroy, register, or surrender their legally acquired pistol-braced firearms.
